By "buyer" initialing this space ______ he/she is bound by this contract to not intentionally breed
required spay/neuter animals for any reason. 

"Seller" will provide registration application to "Buyer" upon receiving verification in writing from attending veterinarian performing the spay/neuter that the spay/neuter is complete on all puppies/dogs sold without breeding rights.  By signing this contract "Buyer" is bound by this
agreement to NOT breed any dog sold without breeding rights.

"Seller" keeps first right of refusal on all puppies/dogs sold with breeding rights for
the current market value at time of sale.

"Seller" requires all puppies sold with breeding rights to have their registered name
with any/all registries start with: BOOT TOP


The "Seller" will provide up to date health record information to "Buyer" at time of transfer of
dog/puppy verifying all vaccinations and deworming up to date for appropriate age.

"Seller" guarantee's dog/puppy to be sound and free of diseases at time of transfer of said
dog/puppy to "Buyer" for a period of (3) days. "Seller" is not held responsible for stress related
outbreaks caused by transfer of said puppy to a new environment.  "Seller" will make
themselves available to "Buyer" for questions, concerns, and to assist with advice on
any level to maintain a smooth and as stress free as possible transition.

"Buyer" will contact "Seller" immediately upon seeing signs of stress, weakness, or illness
during the adjustment transition period. "Buyer" is required to take said puppy/dog to a
qualified veterinarian immediately upon seeing signs of distress. "Buyer" is required follow
all instructions provided by veterinarian to assure a full recovery.

"Buyer" agrees to have said puppy examined by a licensed small animal veterinarian within (3)
days of receipt of said puppy.  By signing this contract, "Buyer" waves the health guarantee if
not examined during this three day period.  If said puppy is found to be in poor health during this
time period, as evidenced by a signed, written report by a licensed veterinarian, buyer will have
the option to return the puppy at "Sellers" expense for a full refund or replacement as soon as
comparable (of equal value)  becomes available. "Seller" has the right to request a second
opinion from a non-associated veterinarian within a reasonable distance of "Buyers" home.
To refund or replace will be the choice of the "Buyer". If "Buyer" decides to keep said dog/puppy
they will assume all expenses involved with said dog/puppies care.

"Seller" warrants that said puppy/dog is the progeny of breeding dogs examined and certified
by the Canine Eye Registration Foundation as approved for safe breeding, cleared free of
hip dysphasia by the Orthopedic Foundation for Animals, and have recorded results of not
being positive for PRA or CEA.

"Seller" will replace (of equal value) or refund with proper verification for the following
genetic defects:
1.       Failure to receive a passing rating on hips from the Orthopedic Foundation for Animals.
2.       Failure to receive a passing reading from Canine Eye Registration Foundation.
3.       Additional debilitating conditions due to genetic health problems must be discovered
         24 months from birth of said dog/puppy.  They must be submitted by two different
         veterinarians at two different clinics certifying that said dog/puppy is suffering from one of
         the following: Thyroid, epilepsy, immune suppression, Positive PRA, Positive CEA.
At that time "Buyer" can either keep said dog/puppy and assume all medical expenses with a
refund of half of purchase price from "Seller" or return said dog/puppy at "Buyers" expense for
a replacement puppy of equal value.

"Buyer" certifies, by signing this agreement, that said puppy/dog will live with the "Buyer".
"Buyer" certifies, by signing this agreement, that said puppy/dog will have adequate exercise,
shelter, nutritious food, fresh water, and all necessary health care from a licensed veterinarian.
"Buyer" certifies, by signing this agreement, that said puppy/dog will be given all necessary
vaccinations and deforming necessary to keep said puppy/dog healthy and safe from disease.
"Buyer" certifies, by signing this agreement, that he/she is not acting as an agent in this purchase.
"Buyer" certifies, by signing this agreement, that he/she will not sell said puppy/dog to a pet
store, guard dog business, or research facility.

"Seller" reserves the right to refuse the sale of one of our dogs to anyone. The "Seller" reserves
the right to first purchase option on any BOOT TOP dog/puppy that said BUYER offers for sale.

"Seller" has the right to, at any time, decide to stop breeding Toy/Miniature Australian Shepherds.
In this case, if a replacement puppy can not be given, then all monies for the purchase of said
dog/puppy will be refunded to the "Buyer".

"Seller" makes no guarantees regarding accidental death, theft, sickness due to lack of
vaccinations, lack of deworming or lack of proper care.  In the case of lack of proper care
the decision if proper care is the cause will be determined by two veterinarians from two
different veterinary practices not associated with each other.



"Buyer" has the option to pick up their puppy/dog at Boot Top Aussies or to have said puppy/dog
shipped by air. All airline charges are the expense of the "Buyer".

If "Buyer" chooses to have said puppy/dog shipped, "Seller" will research all airlines for most
economical flight. "Seller" will always give first preference to the comfort and safety of said
puppy/dog as a priority. "Seller" will make all flight arrangements keeping in mind "Buyers"
time zone and convenience whenever possible. "Seller" will supply selected airlines with a
official veterinary health certificate. "Seller" will  supply a safe, airline approved shipping crate.
"Seller" will deliver said puppy/dog to the airport with all necessary documentation. "Seller" will
notify "Buyer" by supplied phone number when said puppy/dog has been officially signed over
to the designated airport. "Buyer" will immediately upon receipt of said puppy/dog call "Seller"
to notify "Seller" that "Buyer" has taken possession of said puppy/dog.

"Buyer" certifies by signing this agreement, they understand that a puppy/dog rated as
Show/Breed Quality is defined as a puppy that has the potential to be shown and titled in
the conformation ring and could be used for breeding. "Seller" does not guarantee that the
puppy/dog will attain a Championship title in the conformation ring. "Seller" does not guarantee
a puppy to stay within size standard. (i.e., a Toy with a size limit of 14" could mature over 14"
then classifying it as a Mini). The "Buyer" is highly suggested by the "Seller" to present any
puppy/dog rated as Show/Breed Quality for re-evaluaton by the "Seller" if "Buyer" has the
opinion a puppy rated as Show/Breed Quality should be re-classified as Pet/Companion.
If the "Seller" finds said puppy to need to be re-classified, the "Breeder" will replace said puppy
with another Show/Breed Quality potential puppy. At that time the "Buyer" will have the option
to keep the first puppy at Pet/Companion price with a refund of the difference between the
original purchase price of said first puppy and pet/companion price once said first puppy is
spayed. "Buyer" must sell or keep first puppy as a pet/companion without breeding rights
once re-classified as such.

"Buyers" purchasing a show/breeding potential puppy with breeding rights must have
said puppy/dog 's eyes officially certified with a Certified Veterinary Ophthalmologist at one
year of age, OFA preliminary hip x-ray for hip dysplasia at one year, and OFA official hip
x-ray for hip dysplasia at two years of age.


A $200.00 deposit is required to reserve a puppy. The "Buyer" understands that there may be
2(two) reserves on one puppy. One reserve if the puppy is evaluated as a pet, a separate reserve
if the puppy is evaluated as a show/breeding puppy at said puppies quality evaluation performed
between 8 - 9 weeks of age. If said puppy evaluates differently than you have reserved,
(reserved show/breeding and evaluates pet or reserved pet and evaluates show/breeding)
it will be the decision of the "Buyer" to get a full refund from the "Seller" for the reserve, or wait
for the next litter and keep the reserve on file. The said dog/puppy may be paid for by the following:
1.       By check. This must be paid at least 10 days prior to transfer of said dog/puppy to clear bank.
2.       By account to account wire transfer. This can be done same day prior to transfer of said
          puppy/dog. All fee's are those of the "Buyer"
3.       By credit card using Pay Pal. "Buyer" will be charged a 3% processing fee charged by
         Pay Pal.
"Buyer" agrees that this contract is non-transferable.
"Buyer" has read and understands the foregoing and agrees that all parts of this contract are a
binding agreement with the "Seller". If either the "Buyer" or "Seller" takes legal action regarding
this contract, action will be initiated in the county of the "Seller's" residence. Legal fees and court
costs shall be the responsibility of the party found at fault.
